Who we are and what this covers
Tubaar is operated by Nevolut S.A.R.L.U. (Democratic Republic of Congo) together with its European Union branch Nevolut S.R.L. (Romania) — together "Nevolut", "we", "us". These Terms of Service (the "Terms") cover the Tubaar mobile applications, the tubaar.com website, and every feature available through them (the "Service"), including Pulse, Echo, Scenes, Stories, Create, Inbox, live broadcasts and Creator Space.
The Privacy Policy, the Community Guidelines, the Child Safety Standards and the Copyright & IP Policy are part of these Terms. If any of them conflicts with this document on a specific point, the more specific document wins for that point.
Tubaar shares its account system with Ontryst, a separate social-discovery service operated by the same company. One account signs you in to both. Ontryst's own terms govern Ontryst; these Terms govern Tubaar.
Summary (not a substitute for the rest)
- You must be 13 or older. Members under 18 get a protected experience.
- You can watch public videos without an account. Creating, Echoing, following, commenting and messaging need one.
- You own what you create. You give us the licence we need to show it, and you let other members Echo it within the limits you choose.
- Follow the Community Guidelines. We can remove content, limit reach or suspend accounts, and we tell you why and how to appeal.
- Tubaar is free today. If we introduce paid features, they'll be clearly marked and governed by Section 12.
- You can delete your account at any time; the account is shared with Ontryst, so deleting it removes both.
Who can use Tubaar
To create an account you must be at least 13 years old — or older where the law of your country sets a higher minimum age for consenting to online services (for example 16 in some EU member states without parental consent). If you are under 18, you confirm that a parent or guardian has reviewed these Terms with you and agrees to them on your behalf where that is required.
You may not use the Service if you have previously been permanently banned from Tubaar or Ontryst, or if you are prohibited from receiving services under applicable sanctions or export laws.
Members aged 13–17 receive a protected experience described in the Child Safety Standards: limited discoverability, restricted messaging from adults, filtered recommendations and no live broadcasting. We use the date of birth you provide, and may use other signals, to apply those protections. Misstating your age is a breach of these Terms.
Watching as a guest
You can open Tubaar and watch public content without signing in. Guests are anonymous readers: we don't create an account or a profile for you, and anything you do as a guest (watching, scrolling, searching) isn't stored against an identity. Guests still have to respect these Terms — in particular Section 8 (acceptable use) and Section 9 (intellectual property) — and guest access to some content or features may be limited or withdrawn at any time.
Your account
- One account per person. Accounts are personal, may not be sold, rented or transferred, and may not be created for someone else or with automated means.
- Accurate information. Your name, handle and date of birth must be accurate. Handles that impersonate a person, brand or Tubaar itself, or that squat a name you have no connection to, may be reclaimed.
- Keep it secure. Sign-in uses one-time codes sent to your phone number. You're responsible for keeping that number and your device secure and for everything done through your account. Tell us immediately at support@tubaar.com if you think someone else has access.
- Shared with Ontryst. The same credentials open both apps. Your Tubaar activity stays in Tubaar unless you choose to publish a video to both. Deleting the account deletes it everywhere.
- Verified badges confirm an account is who it says it is. They are granted at our discretion, can be withdrawn, and don't endorse the account's content.
Our licence to you
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Tubaar app on devices you own or control and to access the Service, for personal, non-commercial use — or for the commercial uses we expressly allow (for example, creator tools and labelled branded content). You may not copy, modify, reverse-engineer, scrape, frame, or create derivative works from the Service or its software, except where the law says we can't stop you.
The Service, its software, design, logos, the Tubaar name and wordmark, and all content we provide (other than Your Content and other members' content) belong to Nevolut or its licensors. Nothing in these Terms gives you rights in them beyond this licence.
Your Content
You own it. Videos, Echoes, Stories, comments, sounds, captions, messages, profile content and anything else you post or send ("Your Content") remain yours. Nothing in these Terms takes ownership of Your Content.
The licence you give us. So that we can run the Service, you grant Nevolut a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, cache, reproduce, adapt (for example to transcode, compress, generate thumbnails or captions), publish, display, perform, distribute and translate Your Content, in any media, solely to operate, promote, improve and develop the Service. The licence lasts for as long as Your Content is on Tubaar, plus a reasonable period to remove it from backups and caches. Content you have shared with others (for example an Echo someone made, a video re-shared into a Scene chat, or a comment) may remain visible after you delete the original, as described below.
Echoes and remixing. Tubaar's core feature is that members can answer a video with a video. When you publish a video with Echo enabled, you grant every member permitted by your Echo setting a licence to include your video, or part of it, in an Echo — and you grant Nevolut the licence to display the resulting chain. Echoes always credit and link to your original. You can set who may Echo you (everyone, followers, nobody) per video and change it later; changing it stops new Echoes but doesn't delete existing ones. You can detach an Echo from your chain at any time; the Echo remains on its author's profile marked as detached. When you delete a video, Echoes of it stay up on their authors' profiles showing "original removed", because they are their authors' content too.
Sounds. If you allow others to use your original audio, you grant members a licence to use that sound in their own videos, with credit to you. Music provided through Tubaar's catalogue is licensed to you for use in videos on Tubaar only, and may be muted or removed if the licence ends. See the Copyright & IP Policy.
Your promises about Your Content. You confirm that you own or have the rights needed to post Your Content and to grant these licences; that it doesn't infringe anyone's rights, including privacy, publicity, copyright or trademark; that everyone recognisable in it has consented to appear; and that it complies with the Community Guidelines. Where moral rights apply, you agree not to assert them against Nevolut or other members in a way that prevents the normal operation of the Service (for example, an Echo or a sound reuse you enabled).
Feedback. If you send us ideas or suggestions, we may use them without obligation to you.
Our rights over content. We may, but aren't obliged to, review, label, restrict, demote, remove or refuse to transmit any content, and we may preserve and disclose content where Section 14 or the law requires it.
Acceptable use
The Community Guidelines set out in detail what is and isn't allowed. In short, when using Tubaar you must not:
- post, share or send anything illegal, or that sexualises, endangers or exploits a minor — see the Child Safety Standards;
- harass, threaten, intimidate, dox, stalk or defame anyone, or use Echo, comments, Scenes or messages to target a person;
- post hateful, violent, extremist, self-harm, dangerous-challenge or graphic content beyond what the Guidelines allow;
- post nudity, sexual content or sexual solicitation, or content that sexualises anyone without consent;
- mislead people — impersonation, scams, undisclosed paid promotion, deceptively edited or AI-generated media presented as real, fake engagement;
- infringe anyone's intellectual-property, privacy or publicity rights;
- use bots, scrapers, automation, or any means to collect data, create accounts, inflate views, loves, Echoes or followers, or to access the Service other than through the interfaces we provide;
- interfere with the Service's security or operation, probe or bypass its protections, or upload malicious code;
- evade a ban, a restriction or an age protection, including by creating another account;
- sell or trade accounts, handles, badges, or access to the Service.
Intellectual property and copyright
We respect creators' rights and expect you to as well. Our Copyright & IP Policy explains how to report content that infringes your copyright or trademark, how counter-notices work, and our repeat-infringer policy: accounts that repeatedly infringe are terminated. Music in Tubaar's catalogue is licensed for use on Tubaar only; using it elsewhere, or using unlicensed music, is your responsibility.
Moderation, enforcement and appeals
We use a combination of automated systems and human reviewers to find content and behaviour that breaks these Terms or the Guidelines. Depending on severity and history, we may:
- remove content;
- restrict content — make it ineligible for recommendation in For You, age-restrict it, add a warning screen, mute its audio, or limit where it appears;
- limit features — for example commenting, Echoing, messaging, posting into Scenes, or going live, for a period;
- issue a strike; strikes expire over time, and accumulated strikes lead to longer restrictions;
- suspend or permanently ban an account. Severe violations — child safety, credible threats of violence, serious repeat abuse — lead to an immediate permanent ban without prior strikes.
When we act on your content or account you'll be told what we did and, except where the law or safety prevents it, why. You can appeal from the notification or by emailing support@tubaar.com; a person who wasn't involved in the original decision reviews appeals. Removed content may be kept for a limited period to handle the appeal and to meet legal obligations.
Decisions to permanently ban an account, or decisions with legal effect, always involve human review.
Scenes, live broadcasts and messaging
Scenes. Creating a Scene makes you its first moderator. Moderators agree to enforce the Guidelines inside their Scene, to remove violating posts and members, and not to use moderator tools to harass. We may remove moderators, transfer a Scene, or close it, including where it's inactive or repeatedly hosts violations. Scene names and covers must not infringe rights or mislead.
Live. Live broadcasts are available to members 18 and over in good standing. Hosts are responsible for what happens on their stream, including guests they bring on. Lives are moderated in real time and can be ended without notice. We may keep a recording for a limited period for safety review.
Messages and Scene chats. Messages are private between participants, but they're still subject to these Terms. The recipient can report a message, and reported messages are reviewed. We don't proactively read private messages except through automated safety scanning described in the Privacy Policy.
Paid features, purchases and creator earnings
Tubaar is free to use today, and the mobile apps currently contain no in-app purchases. We may introduce paid features in future — for example virtual items, creator tips, Scene subscriptions, promotion tools or premium editing tools. If we do, the price, what you get, the billing period and the cancellation rules will be shown before you pay, and this Section will apply.
- Store purchases made through the Apple App Store or Google Play are also subject to that store's terms, including its refund rules; manage and cancel them in your store account.
- Subscriptions renew automatically at the end of each period at the then-current price until cancelled. Cancellation takes effect at the end of the current period.
- Virtual items (if offered) are a limited licence to use a feature inside Tubaar. They have no cash value, can't be exchanged outside the Service, and may be changed or withdrawn.
- Creator earnings (if offered) are subject to separate creator terms, eligibility, identity and tax checks, and minimum payout thresholds.
- Your right to cancel (EU/EEA/UK consumers). You have 14 days to withdraw from a paid digital service. If you ask us to start providing it immediately and acknowledge that you lose the right to withdraw once it's fully delivered, that right ends accordingly; for a subscription you may still withdraw within 14 days and be refunded pro-rata.
- Refunds. Except where required by law or by a store's policy, payments are non-refundable. If we materially reduce a paid feature you've already paid for, you can cancel and request a pro-rata refund.
Third-party content and services
Tubaar contains content posted by other members and may contain links to third-party sites and services. We don't endorse and aren't responsible for them. Dealings you have with other members or third parties — including collaborations, commissions, brand deals arranged through Tubaar, or meet-ups — are between you and them.
Privacy and data
How we collect, use and share personal data is explained in the Privacy Policy. By using the Service you acknowledge it. We may access, preserve and disclose account information and content where we believe in good faith it is necessary to comply with the law or a valid legal request (see our Law Enforcement Guidelines), to enforce these Terms, to address fraud or security issues, or to protect the safety of any person.
Ending the relationship
By you. Delete your account from Settings or via the delete-account page. There's a 30-day grace period during which signing back in cancels the deletion; afterwards, data is erased as described in the Privacy Policy. Because the account is shared with Ontryst, deletion removes both.
By us. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable, we'll give notice and an opportunity to appeal. Sections that by their nature should survive (Your Content licences for content already shared, intellectual property, disclaimers, limitation of liability, disputes) survive termination.
Changes to the Service and to these Terms
Tubaar is actively developed. We may add, change or remove features, and may suspend or stop the Service or any part of it. Where a change materially reduces a feature you have paid for, Section 12 applies.
We may update these Terms. For material changes we'll notify you in the app, by email or by push notification at least 30 days before they take effect, and we'll update the effective date above. If you keep using Tubaar after that date, the new Terms apply. If you don't agree, stop using the Service and delete your account before the change takes effect.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, secure, or that content will be accurate, reliable or preserved. We don't verify members' identities beyond what we describe, and we aren't responsible for members' content or conduct, on or off Tubaar. Nothing in these Terms limits rights that consumer law grants you and that can't be waived.
Limitation of liability
To the extent permitted by law, Nevolut, its affiliates, officers, employees and partners are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or content, arising from your use of the Service — whether in contract, tort or otherwise — even if advised of the possibility. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or 100 US dollars (or the equivalent). These limits don't apply to liability that can't be limited by law, including for death or personal injury caused by our negligence, fraud, or gross negligence.
Indemnity
If you are using the Service for business purposes, you agree to indemnify Nevolut against claims, losses and costs (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms. Consumers are only liable to the extent provided by applicable law.
Governing law and disputes
These Terms are governed by the laws of the Democratic Republic of Congo. If you are a consumer in the European Union, European Economic Area or United Kingdom, you also benefit from the mandatory consumer-protection rules of the country where you live, and you may bring claims in your local courts. EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
Before bringing a formal claim, please contact us at legal@tubaar.com so we can try to resolve it informally. Nothing in this Section prevents either party from seeking injunctive relief to protect intellectual-property rights or to stop abuse of the Service.
General
- These Terms, with the documents they incorporate, are the entire agreement between you and Nevolut about the Service.
- If part of these Terms is found unenforceable, the rest stays in force.
- If we don't enforce a provision, that isn't a waiver.
- You may not assign these Terms. We may assign them to an affiliate or a successor in connection with a merger, acquisition or sale of assets.
- Apple and Google are not parties to these Terms and have no obligations regarding the Service, but are third-party beneficiaries of them as required by their store terms.
- Where we provide a translation of these Terms, the English version prevails in case of conflict.
