Copyright & IP Policy

Tubaar is built on creators' work, so we take intellectual property seriously in both directions: we protect what you make, and we act on content that infringes others' rights. Repeat infringers lose their accounts.

The basics

  • Only post content you created or have permission to use — video, audio, images, text.
  • Echoes are licensed by design: when a creator enables Echo on a video, they grant other members a licence to include it in an Echo, with automatic credit. That licence doesn't extend to downloading and re-uploading someone's video as your own, or using it outside Tubaar.
  • Sounds: music in the Tubaar catalogue is licensed for use in videos on Tubaar only. Original audio you share as a "sound" is licensed to other members for use on Tubaar with credit to you.
  • Using copyrighted music that isn't in the catalogue, or footage you don't own (matches, films, TV, concerts), may result in the audio being muted, the video being removed, and a strike.
  • Trademarks: don't use another's brand name, logo or handle in a way that suggests affiliation or endorsement.

Reporting copyright infringement

If you are a rights holder (or authorised to act for one) and believe content on Tubaar infringes your copyright, send a notice to copyright@tubaar.com or use the in-app report option "Intellectual property". A complete notice includes:

  • identification of the copyrighted work you claim is infringed (or a representative list);
  • the URL(s) or handle(s) of the allegedly infringing content on Tubaar, specific enough for us to locate it;
  • your name, address, phone number and email address;
  • a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
  • a statement, under penalty of perjury where applicable, that the information is accurate and that you are the rights holder or authorised to act for them;
  • your physical or electronic signature.

On a complete notice we remove or disable access to the content promptly, notify the uploader with a copy of the notice (minus your contact details unless the law requires them), and record a strike. Knowingly false notices can make you liable for damages; we may ignore or report abusive notices.

Counter-notice

If your content was removed and you believe it was a mistake or a misidentification — for example you own it, you have a licence, or it's a lawful quotation, parody, commentary or another permitted use — you can send a counter-notice to copyright@tubaar.com including: identification of the removed content and where it appeared; your name, address, phone number and email; a statement under penalty of perjury that you believe in good faith the content was removed by mistake; consent to the jurisdiction of the competent courts and to accept service from the person who filed the notice; and your signature.

We forward the counter-notice to the original complainant. Unless they tell us within 10 business days that they have sought a court order against you, we may restore the content. Counter-notices are not appropriate for content you simply want back; they are a legal statement.

Repeat infringers

We keep a record of copyright strikes. Strikes expire after 90 days if no new ones are received. Three active strikes result in termination of the account, and we may terminate earlier for flagrant cases. Terminated users may not create new accounts. Strikes are removed if a counter-notice succeeds or the complainant withdraws.

Automated audio and video matching

We use audio and video fingerprinting to detect catalogue and third-party content. Depending on the rights holder's instructions, matched content may be allowed with credit, muted, blocked in certain countries, or removed. You'll be told when a match affects your video and can dispute it from the notification if you believe you have the rights or the use is permitted.

Trademark complaints

To report a trademark violation, email copyright@tubaar.com with the trademark, its registration details and jurisdiction, the infringing content or handle, and why it causes confusion. Nominative, descriptive, parody and fan uses are generally permitted where clearly labelled.

Your rights as a creator

You keep ownership of everything you post (see Terms, Section 7). You control who may Echo you and whether your original audio can be reused. If someone re-uploads your video as their own, report it with the "Intellectual property" option or email us; we prioritise creator-originated reports and can match the re-upload against your original automatically.
